It should also be noted that exceptions to jurisdiction have been accepted by the legislature.However, the advisory theory of the Legal Department of the Judiciary, No. 2462/93/7, introduces another exception for deviating from the rules of jurisdiction, which has no legal basis.The theory says that the prosecutor's office can intervene in crimes against chastity that have been delegated to the court.Consequently, in order to prevent the disappearance of the effects of the crimes subject to Article 102 of the Code of Criminal Procedure, the prosecutor's office can intervene in the jurisdiction of the criminal court. Therefore, in case of fulfilling some conditions, such as the necessity and urgency for the intervention of the prosecutor's office and also the absence of a judge on duty in the court, in order to issue the necessary orders, the prosecutor's office can intervene.}, keywords = {Consultative theory of Legal Department,Necessity and urgency,Article 102 of the Code of Criminal Procedure,Article 306 of the Code of Criminal Procedure,Crimes against Chastity,Jurisdiction Exceptions}, title_fa = {امکان سنجی مداخله دادسرا در صلاحیت دادگاه کیفری نسبت به جرایم منافی عفت در پرتو نظریه مشورتی شماره ۲۴۶۲/۹۳/۷ اداره حقوقی قوه قضائیه}, abstract_fa = {وجود وصف مهم و اساسیِ آمره بودن در قواعد حاکم بر صلاحیت، تضمینی برای اِعمالِ صحیحِ حاکمیتِ دولت در معنای عام و همچنین برقراری عدالت در عرصه‌های مختلف تقنینی، قانونی، قضایی و اجرایی است. به همین دلیل، رعایت قوانینِ ناظر بر اجرای صحیحِ قواعدِ صلاحیتْ امری است مهم که می‌بایست مورد توجه دستگاه‌های مختلف، از جمله محاکم قضایی، قرار گیرد. این در حالی است که وجود برخی شرایط خاص و استثنایی سببِ نقضِ قواعدِ صلاحیتِ محاکمِ کیفری می‌شود، که به آن «استثنائات صلاحیت» گفته می‌شود. در این میان، نظریۀ مشورتی ادارۀ حقوقی قوۀ قضائیه، به شمارۀ ۲۴۶۲/۹۳/۷، حکایت‌کنندۀ استثنائی دیگر برای عدول از قواعد صلاحیت است که فاقد مبنای قانونی می‌باشد و به‌موجب آن، امکان مداخلۀ نهاد دادستانی یا دادسرا نسبت‌به جرائم منافی عفتی که به‌موجب قانون، صلاحیت رسیدگی به آن‌ها در اختیار دادگاه‌های کیفری قرار گرفته‌است فراهم می‌گردد بر این اساس، با هدف جلوگیری از امحای آثار جرم در جرائم موضوع مادۀ ۱۰۲ قانون آیین دادرسی کیفری و با توجه به مفاسد و مصالح آن، امکان دخالت در صلاحیت دادگاه توسط دادسرا، آن‌هم به قدر متیقن و کافی، وجود دارد. بنابراین درصورت احراز برخی شروط، مانند وجود ضرورت و فوریت برای اقدام مداخله‌جویانۀ دادسرا و همچنین نبودِ قاضیِ کشیک در دادگاه جهت صدور دستور لازم، می‌توان جواز مداخلۀ دادسرا در صلاحیت دادگاه کیفری، نسبت‌به جرائم منافی عفت را مورد پذیرش قرار داد.}, keywords_fa = {نظریه مشورتی اداره حقوقی,ضرورت و فوریت,ماده ۱۰۲ قانون آیین دادرسی کیفری,ماده ۳۰۶ قانون آیین دادرسی کیفری,جرایم منافی عفت,استثنائات صلاحیت}, url = {https://www.lthjournal.ir/article_248309.html}, eprint = {https://www.lthjournal.ir/article_248309_e8e48aa210bfb025ea7d267c80fd2ab7.pdf} }
