In this context, civil law in Rule 140 states four reasons for ownership which they are also the methods of property transfer. On the other hand, respect for private property of individuals has always been subject to the legislator's attention and has formed the foundation of many laws on legal and criminal issues.  In this article, the author seeks to analyze the status of lands that have a special owner and squatter, but the land has been underwater due to the coming forth of sea water, lakes or rivers, and it is not possible to determine the situation of the former and current state. The main questions that can be discussed in this field are whether this condition causes the deterioration of land ownership? Do people still own those properties? For example, can they build buildings or use other uses with up-to-day equipment on seawater in their ownership limits? Or is private property rescinded and, in accordance with Principle 45 of the Constitution, it is a public property? And in the recent assumption, if the sea water returns later, can individuals claim ownership based on their former ownership? Therefore, if the sea moves forward in the coastal area, so that some land and houses of some people are under water, in the conflict between private property and public interests, the protection of public property will arise.}, keywords = {Ownership,land,Anfal,Public Wealth,Private Property}, title_fa = {بررسی فقهی و حقوقی مالکیت اراضی اشخاص، در اثر پیش‌روی آب دریا}, abstract_fa = {تحصیل مالکیت و زوال آن در قانون مدنی و فقه امامیه، مبتنی بر اسباب خاص و معین است. درهمین زمینه قانون مدنی در مادة 140 چهار سبب برای تحصیل مالکیت نام می‌برد که به‌طریق اولی همان طرق سبب انتقال ملکیت نیز هستند. از طرف دیگر احترام به مالکیت خصوصی اشخاص همواره مورد عنایت قانون‌گذار بوده و شالودة بسیاری از قوانین موضوعة حقوقی و کیفری را تشکیل داده است.  نگارنده در این نوشتار در صدد تحلیل و بررسی ملکیت و وضعیت تصرف زمین­هایی است که مالک و متصرف خاص داشته، اما زمین مذکور به‌دلیل پیش‌روی آب دریا، دریاچه و یا رودخانه‌ها، به زیر آب رفته و امکان از بین بردن وضعیت حادث و تحصیل وضعیت سابق در حال حاضر میسر نیست. عمده‌ترین پرسش‌های قابل طرح در زمینة مورد بحث این است که آیا وضعیت حادث سبب زوال مالکیت مالک زمین می‌شود؟ آیا اشخاص همچنان بر آن املاک مالکیت دارند؟ مثلاً می‌توانند با تجهیزات روز روی آب دریا در محدودة مالکیت خود احداث بنا، یا استفادة دیگری کنند؟ یا این که مالکیت خصوصی زایل شده و با توجه به اصل 45 قانون اساسی املاک مزبور جزو انفال است؟ و در فرض اخیر چنانچه در سال‌های آتی آب دریا پس‌روی کند، آیا اشخاص براساس مالکیت سابق خود، می­توانند ادعای مالکیت کنند. درنتیجه با توجه به تحقیق  به‌عمل آمده اگر در منطقة ساحلی دریا پیش‌روی کند، به‌گونه‌ای که برخی اراضی، منازل و حتی محل کسب عده‌ای زیر آب رود، در اصل تعارض بین مالکیت خصوصی و منافع عمومی، حمایت از اموال عمومی به‌وجود می‌آید.}, keywords_fa = {مالکیت,اراضی,انفال,ثروت‌های عمومی,اموال خصوصی}, url = {https://www.lthjournal.ir/article_242504.html}, eprint = {https://www.lthjournal.ir/article_242504_0e053cf27c9a9f26cc59f5537d037d30.pdf} }
